Terms of Service

These terms cover booking a session with Upswing Photography and ordering from our shop. Booking a session or placing an order means you agree to them.

Booking and payment

• A date is held once your deposit clears — 10% for portrait sessions, 20% for weddings and events.
• The balance is due before your session. Wedding payment plans are available; just ask.
• Deposits are non-refundable, because holding your date means turning away other work. If you need to move your date, see below.

Rescheduling, weather, and cancellation

• Florida weather happens. If conditions make your session unsafe or unworkable, we will reschedule at no cost.
• You may reschedule once at no charge with at least 48 hours' notice; your deposit moves with you.
• If you cancel entirely, the deposit is not refunded, but it stays on file as credit for twelve months.
• If we ever have to cancel for a reason of our own, you receive a full refund including the deposit, and we will help you find another photographer.

Your photographs and how they may be used

• We retain copyright in the images we create, as photographers do.
• You receive a personal-use print release: print them, share them, send them to family, post them. Please do not sell them or use them commercially without asking us first.
• Please do not apply filters or crops to images before posting them publicly — the edit is part of the work.
• We may use selected images in our portfolio and marketing. You can opt out at any time by emailing us, before or after the session, and we will keep your images private.

Delivery

A sneak peek usually arrives within 72 hours. Full galleries are delivered through your private Pixieset portal — typically two to three weeks for portraits and six to eight weeks for weddings. Galleries stay online for at least twelve months; please download and back up your files.

The shop

• Prints, canvases, and albums are made to order. Because each is produced individually, they cannot be returned — but if something arrives damaged or is not right, tell us within 14 days and we will replace it.
• Prints ship within 7–10 business days. Shipping is a flat $12, free over $300.
• Gift certificates are delivered by email, valid for twelve months, and cannot be exchanged for cash.
• Florida sales tax applies to physical items.

Your responsibilities

Please arrive on time — sessions are booked around specific light and cannot usually be extended. Where a session takes place on private property or a venue requiring a permit, arranging permission is the client's responsibility unless we have agreed otherwise.

Limits

In the unlikely event of equipment failure, data loss, or another circumstance beyond our control, our liability is limited to a refund of the amounts you have paid us. We carry professional equipment, shoot to dual memory cards, and back up every session promptly — but we would rather state this plainly than leave it unsaid.

Governing law

These terms are governed by the laws of the State of Florida.
